Our Privacy Policy sets out how we collect, use, store and disclose your personal information, including health information.

Because we provide a health service, we are bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth), and by the Health Records Act 2001 (Vic) and the Health Privacy Principles in respect of health information we handle in Victoria.

Our registered psychologists are also bound by professional confidentiality obligations.

By providing personal information to us, you consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy and any other arrangements that apply between us.

We may change our Privacy Policy from time to time by publishing changes to it on our website. We encourage you to check our website periodically to ensure that you are aware of our current Privacy Policy.

Personal information includes information or an opinion about an individual that is reasonably identifiable. It includes health information, which is information about your health, your healthcare and health services provided to you. Health information is sensitive information and receives a higher level of protection under the law.

What personal information do we collect?

We may collect the following types of personal information:

  • name, date of birth and contact details, including mailing or street address, email address and telephone number;
  • if you are a client or prospective client of our psychology services:
    • emergency contact details;
    • information relevant to your care, including your presenting concerns, personal and health history, referral information and correspondence with other treating practitioners;
    • the clinical records our psychologists are professionally required to keep; and
    • billing information, including Medicare and private health fund details, if applicable;
  • if you participate in one of our workplace programs:
    • your employer, role and work contact details for program administration;
    • attendance information; and
    • any responses you choose to provide in program surveys, assessments or facilitated sessions;
  • if you are a contact at an organisation we work with or may work with:
    • your business contact details; and
    • information about your organisation relevant to designing and delivering our programs;
  • your device ID, device type, IP address, statistics on page views, traffic to and from our website and standard web log information;
  • details of the services we have provided to you or that you have enquired about, including any additional information necessary to deliver those services and respond to your enquiries;
  • information you provide to us through surveys; and
  • any other personal information that may be required in order to facilitate your dealings with us.

We endeavour to collect your information directly from you, including through enquiries, the intake and assessment process, sessions, forms and correspondence. However, in some circumstances we may collect your information from third parties, such as a referrer or another treating practitioner with your consent, your employer for the limited purpose of administering a workplace program (such as your name and work email address), or from a publicly available record.

We only collect health information and other sensitive information with your consent, or where the collection is otherwise required or authorised by law. By completing our intake process and participating in our services, you consent to us collecting the health information reasonably necessary to provide those services. You may withdraw your consent at any time, although this may affect our ability to continue providing services to you.

In addition, when you apply for a job or position with us we may collect certain information from you (including your name, contact details, working history and relevant records checks) from any recruitment consultant, your previous employers and others who may be able to provide information to us to assist in our decision on whether or not to make you an offer of employment or engage you under a contract. The Privacy Act contains certain exemptions in relation to employee records; where appropriate we make use of relevant exemptions.

You may deal with us anonymously or using a pseudonym where it is lawful and practicable, for example when making a general enquiry. It is not practicable for us to provide psychology services anonymously, because we are professionally required to maintain accurate clinical records.

Why do we collect, use and disclose personal information?

We may collect, hold, use and disclose your personal information for the following purposes:

  • to provide our psychology services, including intake, assessment, treatment and referral;
  • to design, deliver and evaluate our workplace and resilience programs;
  • to communicate with you, including appointment scheduling and responding to enquiries;
  • to process payments and manage our accounts, including Medicare and health fund claims, if applicable;
  • to operate, protect, improve and optimise our website, services and business, such as to perform analytics and conduct research, including through de-identified analysis;
  • to send you service, support and administrative messages, reminders and information requested by you;
  • to comply with our legal and professional obligations, including the record keeping obligations of registered psychologists, to resolve any disputes and to enforce our agreements; and
  • to consider your employment application.

What does your employer receive if you participate in a workplace program?

If you participate in a program arranged by your employer, your employer engages us and may provide us with your name and work contact details for administration. However:

  • anything you say in a facilitated session, and your individual responses to any program survey or assessment, are treated as confidential to you;
  • reporting to your employer is provided only on a de-identified and aggregated basis, and only where the group size is large enough that individuals cannot reasonably be identified; and
  • we do not tell your employer whether you have sought or received individual psychology services from us.

The only exceptions are where you expressly consent, where we are required or authorised by law to disclose information, or where disclosure is necessary to lessen or prevent a serious threat to life, health or safety.

Do we use your personal information for direct marketing?

We may send you direct marketing communications and information about our services, in accordance with the Spam Act 2000 (Cth) and the Privacy Act 1988 (Cth). We do not use health information for direct marketing. You may opt out of receiving marketing materials from us by contacting us using the details set out below or by using the opt-out facilities provided (such as an unsubscribe link).

To whom do we disclose your personal information?

We do not sell personal information. We may disclose personal information for the purposes described in this Privacy Policy to:

  • our team members and related bodies corporate, on a need to know basis;
  • your general practitioner, a referrer or another treating practitioner, with your consent;
  • third party suppliers and service providers, including secure practice management software, information technology, telehealth, accounting and payment providers, under obligations of confidentiality;
  • in de-identified form, for professional supervision and peer consultation, which is a standard professional practice for psychologists;
  • our professional advisers and insurers where reasonably necessary;
  • anyone to whom our assets or businesses (or any part of them) are transferred, subject to the obligations described below under 'How long do we keep your information?';
  • other persons, including government agencies, regulatory bodies and law enforcement agencies, as required, authorised or permitted by law, including in response to a court order or subpoena, to comply with mandatory reporting obligations (for example in relation to child safety), or where necessary to lessen or prevent a serious threat to life, health or safety.

Disclosure of personal information outside Australia

We may disclose personal information outside of Australia to cloud service providers and cloud based platforms used by us (including Xero platform) located in the United States of America. Clinical records are stored in Australia using Halaxy system. Where we disclose personal information overseas, we take reasonable steps to ensure that any overseas recipient will deal with such personal information in a way that is consistent with the Australian Privacy Principles.

Using our website and cookies

We may collect personal information about you when you use and access our website. While we do not use browsing information to identify you personally, we may record certain information about your use of our website, such as which pages you visit, the time and date of your visit and the internet protocol address assigned to your computer.

We may also use cookies or other similar tracking technologies on our website that help us track your website usage and remember your preferences. Cookies are small files that store information on your device. You can disable cookies through your internet browser but our website may not work as intended for you if you do so. We will handle any personal information collected by cookies in the same way that we handle all other personal information as described in this Privacy Policy.

Security

We may hold your personal information in either electronic or hard copy form. We take reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure, and we use a number of physical, administrative, personnel and technical measures to protect your personal information, including Two-factor authentication and secure locked filing storage. However, we cannot guarantee the security of your personal information.

How long do we keep your information?

We retain health records for the periods required by law and professional standards. In Victoria, health records must generally be kept for at least seven years after the last occasion on which a service was provided or, for a person who was under 18 years of age when the record was made, until the person turns 25.

If our practice is sold, transferred or closed, health information will be dealt with in accordance with the Health Records Act 2001 (Vic), and we will make health information available to another health service provider at your request. When personal information is no longer required and no longer needs to be retained by law, we take reasonable steps to destroy or de-identify it.

Data breaches

We are subject to the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth). If a data breach occurs that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner in accordance with that scheme.

Unless expressly stated otherwise, we are not responsible for the privacy practices of, or any content on, those linked websites, and have no control over or rights in those linked websites. Accessing or correcting your personal information

You can request access to the personal information we hold about you by contacting us using the details set out below. We may need to verify your identity when you request your personal information, and we will respond within the timeframes required by law (generally within 30 days under the Privacy Act 1988 (Cth), and within 45 days for health information under the Health Records Act 2001 (Vic)). We may charge our reasonable costs of providing access, but not for making the request itself. For health information, access can also be provided through another health service provider nominated by you.

Sometimes, we may not be able to provide you with access to all of your personal information, for example where access would pose a serious threat to a person's life, health or safety, and, where this is the case, we will tell you why in writing and how you may complain. If you think that any personal information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us and we will take reasonable steps to ensure that it is corrected.

Making a complaint

If you think we have breached the Privacy Act 1988 (Cth) or the Health Records Act 2001 (Vic), or you wish to make a complaint about the way we have handled your personal information, you can contact us using the details set out below. Please include your name, email address and/or telephone number and clearly describe your complaint. We will acknowledge your complaint and respond to you within a reasonable period of time (usually within 30 days).

Please note:

  • the 'clinical intake notice' is intended to satisfy the notification requirements of both APP 5 of the Privacy Act 1988 (Cth) and HPP 1 of the Health Records Act 2001 (Vic) and should be provided with, or incorporated into, the intake and consent paperwork;
  • the 'Workplace program participant Collection Notice' should be acknowledged and agreed by individuals participating in workplace training programs;
  • the 'Website and general enquiry Collection Notice' should be acknowledged and agreed through a 'tick-box' prior to an individual being permitted to submit personal information on the MYM website (such as enquiry webforms); and
  • the 'Telephone call script' should ideally be used where personal information is collected over the phone. However, if that is not practicable, a collection notice must be provided to the individual as soon as practicable thereafter (for example, where an appointment is made over the phone in an appointment confirmation email, which includes the collection notice). It should be noted that many health providers include a pre-recorded message as soon as a call connects which includes the collection call script.

We collect personal information about you, including health information, in order to assess your needs, provide psychology services to you and manage your care, and for purposes otherwise set out in our Privacy Policy at https://mindyourmonkey.com.au/privacy-policy (Privacy Policy). Health information is sensitive information, and we collect it with your consent.

The information you provide will be collected by or on behalf of us and may be disclosed to:

  • your general practitioner, a referrer or another treating practitioner, with your consent;
  • third parties that help us deliver our services (including secure practice management, information technology, telehealth and payment suppliers); and
  • other persons as required or authorised by law, including where necessary to lessen or prevent a serious threat to life, health or safety, or to comply with mandatory reporting obligations.

In de-identified form, information may also be used in professional supervision and peer consultation, which is standard professional practice for psychologists. 2. Workplace program participant Collection Notice

We collect personal information about you (including your name, employer, role, work contact details, attendance information and any responses you choose to provide in program surveys or sessions) in order to administer and deliver the workplace program arranged by your employer, and for purposes otherwise set out in our Privacy Policy https://mindyourmonkey.com.au/privacy-policy (Privacy Policy).

Anything you say in a facilitated session, and your individual survey or assessment responses, are confidential to you.

Reporting to your employer is de-identified and aggregated only, and we do not tell your employer whether you have sought or received individual psychology services from us.

The only exceptions are where you expressly consent, where disclosure is required or authorised by law, or where disclosure is necessary to lessen or prevent a serious threat to life, health or safety.

Submitting an enquiry or booking request through our website does not create a confirmed appointment or engagement.
